PENAL LAW Translation of Book in Penal Law Part 17

Above book continues: The threat of punishment to anyone who didn't pray at the hat of Gesler in the film/book 'Wilhelm Tell (Goulielmos Tellos) of Schiller, for example penalization of act of article 384 P.C for those who amuse themselves, in a non fair way, 'of dignity' from social point of view, the threat of punishment to those who participate in immoral acts, but where these acts do not 'perturbate' social peace in an unbearable way, punishment of ideas or aspects, cannot be justified and have 'no place' in a State of Law. This of course can be discussed, as yes, anyone is entitled to self-disposal of one's personal and private life, but provided these people do not try to convince others through verbal force and words of persuasion, mainly non adult people, who are still adolescents, to follow them and participate in those immoral acts beyond their will. This may involve many illegal acts too, that should be punished by law, as the people who do this, do not have the right, (absolute or relative in this case) to force free will, and personal, actually sexual dignity and substance mainly of young people, should be penalized in my opinion, as this is opposed to basic principle of Natural Law, freedom, and flexibility of it, and to which results this may lead.. For these reasons in regiments of absolutims and totalitarian ones, may punish people who offend themselves, for ex. too much smoking, suicide attempt, yes these acts may be prevented at first place under 'preventive justice' and may be impeded from those who have legal interests, rather legal right on rights of others, to prevent results, like parents, official caregivers in this case, in any other case, this penalization violates acts of freedom opposed to this same freedom of primary source of Law, that is Natural Law, along with Custom Law, mainly involved to norms of 'morality' in a local society, based on what has actually always applied in these cases, and whereas these customs and morality, contribute to maintenance of social peace, and do not force absolute rights of others at the same time, all this in the vast meaning. (continues in Part 18 next time..)
